Fall from Second Story Window

Our client, a 75-year-old man with dementia, was a resident of a memory care unit within a residential care facility. Despite known risks of exit-seeking behavior, the facility failed to implement even basic safety measures to prevent his elopement or respond to alarms. Our client was left unsupervised and was able to barricade his door, open a second-story window, and crawl out onto the ledge. He fell to the concrete below, sustaining multiple traumatic injuries including fractures to his spine, hip, and foot, internal bleeding, and permanent loss of mobility. This case settled confidentially for $1,700,000.00.
