Our client, a dependent adult with physical and cognitive limitations was admitted to an assisted living facility for help with daily activities. Despite her known vulnerability, a male employee with severe psychological issues and a criminal history was left unsupervised and gained access to her room. He sexually assaulted her twice in one night, and although the incident was reported internally, the facility’s leadership failed to notify the family or authorities. The assailant was later arrested for multiple crimes, including assaults on other residents. The survivor suffered significant trauma and was forced to remain in the facility for a period after the assaults due to her care needs. This case settled confidentially for $750,000.00.
