Our client was 78 years old and had a documented history of cognitive impairment. He had previously wandered from other facilities and was admitted to Miracle Mile specifically to be supervised and protected. The complaint alleges that despite these known risks, no effective care plan or meaningful interventions were put in place to prevent him from leaving the facility unsupervised—a risk known in the healthcare industry as “elopement.” This failure resulted in our client being found dead in a public park two days after wandering from the facility.
Timeline:
On November 5, 2024, staff discovered our client missing from his room at 2:45 PM. His family wasn’t notified until 4:50 PM, and the police weren’t called until 5:11 PM—over three hours after he was discovered missing. Two days later, his body was found in a nearby public park.
Cover up: The state discovered that after realizing our client was missing, the facility attempted to cover up their failure by creating a backdated discharge record stating he had left “against medical advice.” Following an investigation, the California Department of Public Health found that the facility had violated state and federal law, failed to protect a known at-risk resident, and had falsified documentation. The agency issued citations and more than $110,000 in fines.
