Partner Jody Moore Delivers Ground-Breaking $13.5 Million Verdict

Oakland, California – October 14, 2021 – Ten nursing home residents were awarded $9.6 million in punitive damages and wrongful death damages after their four-month trial by Zoom against Parkview Healthcare Center in Hayward.

In earlier phases, the jury sided with the residents, finding unanimously that their rights were repeatedly violated and the owner and operator, Parkview Operating Company, LP and Mariner Health Central, Inc. committed neglect and negligence.  The jury found that violations, neglect and negligence were committed with fraud and awarded nearly $3.9 million in compensatory damages.   

The residents are represented by Jody Moore of Johnson Moore, Susan Kang Gordon of the Law Office of Susan Kang Gordon, Jennifer Fiore of Fiore Achermann.  This verdict has significant reach in protecting elders and dependent adults.  The trial team said:  “It sends a message that any nursing home or management company that doesn’t meet the residents’ needs will be held responsible.  Chronic understaffing and fraudulent record-keeping will not be tolerated, especially when it harms the most vulnerable and dependent members of our community.”  

The total verdict of approximately $13.5 Million Dollars does not include the attorney’s fees and costs which remain to be determined by the trial court.
